Terms of Service

1. Acceptance of Terms

Welcome to Oopda Inc. ("Oopda", "we", or "us"), and thank you for your interest in our healthcare bill management tool. Oopda Inc provides the websites Oopdahealth.com and Oopda.ai, the Oopda app, along with related networks, applications, and services (collectively known as the "Service"). These Terms of Service constitute a legally binding contract between you and Oopda Inc concerning your use of the Service. The terms "you" or "your" refer to any entity, organization, company, university, non-profit, or individual end user accessing or using the Service, and by doing so, you agree to these Terms.

By utilizing our Website, you consent to be bound by these Terms of Use (“Terms of Use”) and the Oopda Privacy Statement (“Privacy Statement”). Additional terms may apply to specific programs or services on Oopda’s Apps. If you disagree with any of these terms, please refrain from using Oopda's Apps. Oopda reserves the right to change these terms at its discretion; please refer to Oopda's Apps for updates. Your continued use after such changes signifies your acceptance of the revised terms.

2. Description of Service

Oopda's platform offers tools to manage healthcare bills, such as identifying family members' bills, organizing them into a common format, tracking payments, and facilitating payments with providers. Additional features may be added without notice. The goal of our platform is to streamline the payment experience for patients and their families.

3. Registration

To register, download our app in the Apple Store or Android Play Store, or our website, provide accurate and complete information, including your name and email, and keep this information up to date. Further details may be required post-registration to enhance your experience and service.

4. Restrictions

Our services may not be used for illegal activities, and you must adhere to all laws and regulations. Unauthorized use, including misuse of login details, offensive content, personal misrepresentation, and violation of any third party's rights, is strictly forbidden and may result in termination of your account.

5. Termination

Oopda may change, suspend, discontinue, alter, or terminate its Service at any time to it’s users. Access may be restricted or limited without notice or liability at our discretion.

You may delete your account at any time from within the app. When you delete your account, all of your data is permanently and irreversibly removed, including your profile, uploaded documents, medical bills, line items, audit results, insurance plans, family member records, payment history, and any files stored on our servers. This deletion is immediate and cannot be undone. If you wish to use Oopda again after deleting your account, you will need to create a new account.

6. Limitation of Liability

We accept no liability for damages resulting from our services. THE SITE IS PROVIDED "AS IS," WITHOUT WARRANTIES OR ENDORSEMENTS, EITHER EXPRESSED OR IMPLIED. USE OF OOPDA SERVICE IS VOLUNTARY AND AT YOUR OWN RISK. ANY REFERENCES TO SPECIFIC PRODUCTS OR SERVICES ON THE SITE DOES NOT CONSTITUTE OR IMPLY A RECOMMENDATION OR ENDORSEMENT OF SUCH PRODUCTS OR SERVICES BY OOPDA INC UNLESS SPECIFICALLY STATED OTHERWISE.

Oopda Inc and its affiliates are not liable for damages arising from the Site, Apps, or any third-party websites. Some jurisdictions may not permit certain limitations or exclusions; in such cases, the above may not apply to you.

Oopda and its subsidiaries, affiliates, licensors, suppliers, partners, and/or other third parties, identified or not identified, or linked to through Oopda Service, are not responsible nor liable for any damages, direct or indirect, incidental, punitive, exemplary, consequential, or other damages (including lost data, hacked data, business interruption, profit loss, etc) due to or related to Oopda and its Service or content, including, without limitation, the Service’s use of any information or data you release to Oopda Inc through it’s Service and permit Oopda to release data to any third party partner as necessary to perform Oopda’s services to the user. If you are unsatisfied with Oopda and it’s Service, please provide us your feedback through email and/or stop using Oopda.

7. Governing Law

These terms are governed by Delaware law without regard to its conflict of law principles.

1. Usage Restrictions

Our services are for personal, non-commercial use unless granted otherwise by Oopda Inc.

2. Intellectual Property

All content is the property of Oopda or its licensors, protected by intellectual property laws.

3. User Content

You are responsible for the content and accuracy of the information you submit.

4. Prohibited Conduct

Harmful, fraudulent, threatening, or objectionable conduct is not allowed.

5. Hardware and Software Requirements

To access and retain documents, you will need specific hardware and software, including a device with an internet connection, a web browser with 128-bit encryption, a valid email address, and sufficient storage space. By consenting, you confirm that you have access to the necessary technology.

A. Your Contact Information

Keep your contact information updated. If Oopda sends an email without receiving a delivery failure notification, it is considered delivered.

B. How to Withdraw your Consent

Consent remains effective until you withdraw it by contacting Oopda.

C. Requesting Paper Copies

Consent to electronic documents is required, with paper documents available upon request at possible costs to the user.

Privacy Policy

1. Information We Collect

We collect personal and medical billing information to provide our service. This includes information you provide during registration (such as your name and email address), documents you upload (such as medical bills, Explanations of Benefits, and itemized statements), and information derived from those documents.

Automated Processing

When you upload a document, we use automated technologies including optical character recognition (OCR) and artificial intelligence (AI) to extract and organize billing information such as provider names, dates of service, charges, procedure codes, and payment amounts. This automated processing is central to how Oopda works. If our systems are unable to process a document with sufficient confidence, it is flagged for manual review by our team to ensure accuracy.

2. How We Use Information

We use information for various purposes, including communication, bill payment, customer service, account administration, improvement, and marketing.  Your personal information is to support your needs as a user and improve the product for you, the user.

3. Information Sharing

Your information is not sold or shared without consent, except as required by law or with partner companies for an enhanced user experience.

4. Security Measures

We use industry-standard measures to protect your information. We comply with all applicable security regulations, including HIPAA, to ensure the confidentiality, integrity, and availability of your information. We may update this policy to reflect changes to our security practices. Additionally, we may update our sites, apps and other solutions to improve security without notice.

Breach Notification

In the event of a data breach that affects your personal or medical billing information, we will notify you via email within 72 hours of becoming aware of the breach. The notification will describe the nature of the breach, the types of information involved, and the steps we are taking in response.

Data Retention

We retain your personal information and uploaded documents for as long as your account is active. When you delete your account, all data is permanently removed as described in the Terms of Service above. We do not retain copies of your data after account deletion.

5. Cookies and Tracking

Our website may use cookies to enhance your experience. You may disable cookies in your browser settings. Our mobile apps do not use cookies, advertising identifiers, or third-party tracking. We do not track you across other apps or websites, and we do not share your data with advertisers. Oopda does not participate in ad networks or use any advertising SDKs.

6. Links to Third Party Websites

Links to other websites are provided for convenience or for services to manage your health. Oopda is not responsible for any external content, products, or services.

Oopda is a bill management and organization tool. The information provided by Oopda, including bill analysis, audit results, and suggested actions, is for informational and educational purposes only. It does not constitute professional medical advice, financial advice, legal advice, or professional billing advice.
